Express Wash Concepts LLC, through its subsidiaries doing business as Express Wash Concepts, and its affiliates/subsidiaries Moo Moo Express Car Wash, Flying Ace Express Car Wash, Clean Express Auto Wash, Green Clean Express Auto Wash, Bee Clean Express Car Wash, and any other car wash locations operated, managed, or acquired by Express Wash Concepts LLC, whether currently existing or hereafter established (collectively, “Express Wash Concepts,” “we,” “us” or “our”), offers the Unlimited Wash Club (“UWC”) that allows members to subscribe for a monthly membership plan specifying a level of car wash services. The recurring monthly fee depends on the membership plan purchased for each vehicle.


You must be 18 years of age to create an account or purchase an Unlimited Wash Club membership.



1. MEMBERSHIP AND AUTOMATIC RENEWAL

All Unlimited Wash Club membership plans are a monthly automatic recharge subscription. The credit/debit card on file will be charged every month. The Unlimited Wash Club membership for each vehicle will commence upon your delivery of a valid, accepted debit or credit card (“Payment Method”) to Express Wash Concepts and your acceptance of these Terms.


YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW MONTHLY, AND YOUR PAYMENT METHOD WILL AUTOMATICALLY BE CHARGED ON A RECURRING MONTHLY BASIS UNTIL CANCELED BY YOU OR TERMINATED BY US IN ACCORDANCE WITH THESE TERMS. YOUR PAYMENT METHOD WILL NOT BE CHARGED UNTIL YOU AGREE TO THESE TERMS. YOU RETAIN THE RIGHT, WITHOUT ADDITIONAL COST OR PENALTY, TO CANCEL YOUR MEMBERSHIP AT ANY TIME AS DESCRIBED BELOW.


This monthly charge will typically take place on your enrollment date, but occasionally the charge may process a day early or a day late. Memberships started on the 29th, 30th, or 31st day of a month shall have a Recharge Date on the 28th day of the following month and continue recharging thereafter on the 28th.



2. CANCELLATION BY YOU

Your Recharge Date is the date you enrolled in the Unlimited Wash Club and is the date that your monthly payment for car wash services is processed. You may cancel your membership at any time by providing one (1) day’s notice. If a cancellation request is submitted within 24 hours of the next scheduled Recharge Date, the cancellation will take effect after the next Recharge Date, and services will continue through the end of that final billing period.


All cancellations must be processed through one of the following methods:


Services under a canceled membership will continue through the end of the current billing period up to the next Recharge Date. Paid membership fees are non-refundable and there are no refunds or credits for partially used membership periods.


Upon cancellation, Express Wash Concepts will send a confirmation notice to the email address on file confirming the cancellation and the date through which services will remain active.



3. TERMINATION BY EXPRESS WASH CONCEPTS

Express Wash Concepts may terminate or suspend your membership at any time at its discretion, including but not limited to the following circumstances:

  • Failure to pay: Express Wash Concepts may terminate your membership if a charge is declined in the credit card processing system.
  • Abuse or Safety: Express Wash Concepts reserves the right to terminate UWC membership at any time for abuse and/or safety concerns. When flagged for abuse or safety, cancellations may take place with or without notice.
  • Program Modification or Cancellation: Express Wash Concepts reserves the right to modify or cancel this program and any membership at any time.


4. RATES AND PLAN CHANGES

Monthly membership rates and plans are subject to change at any time without individual member notification. Your continued use of your membership following any rate change constitutes your acceptance of the new rate.


Express Wash Concepts reserves the right to modify monthly membership rates. We will provide members with advance written notice of any rate increase, sent to the email address on file. Your continued use of your membership after the effective date of a rate increase constitutes acceptance of the new rate. If you do not wish to accept the new rate, you may cancel your membership prior to the effective date of the increase in accordance with Section 2.



5. VEHICLE REQUIREMENTS

Your UWC membership is valid for one vehicle only and cannot be shared or transferred to another vehicle without prior notice to and approval from Express Wash Concepts. Express Wash Concepts currently uses RFID windshield tags as the primary method of identifying member vehicles. The RFID tag assigned to your membership must remain securely affixed to the windshield on the driver’s side. Express Wash Concepts is transitioning to License Plate Recognition (“LPR”) technology for member vehicle identification and may use LPR at select locations. By enrolling in the UWC, you consent to the capture and use of your vehicle’s license plate image and data for the purpose of membership identification, account management, and access verification, whether by RFID, LPR, or a combination of both. At locations where LPR is operational, you are responsible for ensuring that your correct and current license plate information is on file with Express Wash Concepts through the customer portal or mobile application. Express Wash Concepts is not responsible for denied access resulting from an unregistered, expired, or improperly displayed license plate. Transfer of a membership to a different or new motor vehicle is allowed with notice to and permission from Express Wash Concepts and requires updating all identification information on file.


Vehicle must meet Express Wash Concepts safety guidelines. Enrollment does not guarantee that these guidelines have been satisfied. Express Wash Concepts is not responsible for damage arising from vehicles that do not comply with its vehicle restrictions and guidelines.



6. VEHICLE RESTRICTIONS AND LIMITS OF LIABILITY

All Members and Non-members using Express Wash Concepts car washes agree that Express Wash Concepts shall not be responsible for damages to themselves, others, or property caused by:

  • Vehicles taller than 86"
  • Vehicles wider than 73" from inside driver side tire to outside passenger tire
  • Trucks with uncovered beds that are not completely empty and free of any kind of debris
  • Vehicles with tires wider than 12.5" or dual (“dually”) tires
  • Trucks with ladder racks

All Members and Non-members agree that Express Wash Concepts shall not be responsible for damages to:

  • Vehicles 7 years or older
  • Bug shields or rain guards of any kind
  • Any style antenna
  • Aftermarket wheels or extended valve stems
  • Power running boards in the down position
  • Windshields with prior chips or cracks
  • Non-factory installed parts and accessories
  • All externally attached items
  • Pre-existing paint imperfections
  • Any prior vehicle damage
  • Accidents due to driver negligence


7. TRUCKS, SUVs, AND HITCHES

All pickup truck beds must be completely empty. No exceptions. Customers, Members, and Non-members agree to this term and shall be held liable for any damages resulting from violation of this rule.


Customers, Members, and Non-members must remove any trailer hitch before entering the car wash, or the vehicle will not be cleaned properly. You will be responsible for all damages as a result of failing to remove hitches.



8. WASH INSTRUCTIONS – REQUIRED RULES

Each member, non-member, and customer agrees to follow and abide by the following rules while using our car wash facilities:

  • CAR IN NEUTRAL
  • FOOT OFF BRAKE
  • HANDS OFF WHEEL
  • WIPERS OFF

CUSTOMERS, INCLUDING MEMBERS AND NON-MEMBERS, WHO FAIL TO FOLLOW WASH INSTRUCTIONS WILL BE HELD LIABLE FOR DAMAGE TO PERSONS, PROPERTY, AND/OR VEHICLES.


Failure to follow these rules may result in problems, accidents, and damages. Members, non-members, and all customers using the car wash shall be responsible for all damages to themselves, others, and property when violating the rules above. These rules are posted at every Express Wash Concepts location.



9. SERVICE AVAILABILITY

Express Wash Concepts reserves the right to close locations due to inclement weather, holidays, equipment maintenance, and upgrades. Services at any given car wash location may also be unavailable due to unforeseen circumstances, whether within or beyond the control of Express Wash Concepts. No refunds or credits will be issued for service unavailability.



10. PAYMENT METHODS

Cash or Express Wash Concepts Gift Cards cannot be accepted for automatic recharge plans. UWC membership plan activation is available through Express Wash Concepts locations. Reactivation can be done at the car wash location or through the online Portal.



11. COMMUNICATIONS AND MARKETING

By providing your email address or phone number, you agree to be contacted by Express Wash Concepts to help manage your account and provide you with important updates regarding services and promotions. You also agree to opt in to receive email and SMS promotions from Express Wash Concepts, but you may unsubscribe at any time.



12. PRIVACY

Your use of Express Wash Concepts services and our online portal and mobile application is also governed by our Privacy Policy, which is incorporated herein by reference. Please review our Privacy Policy at portal.expresswashconcepts.com/privacy-policy. Express Wash Concepts reserves the right, and you authorize us, to use and assign all information provided by or collected from you in any manner consistent with our Privacy Policy.



13. DISCLAIMER AND LIMITATION OF LIABILITY

THE INFORMATION AND SERVICES PROVIDED BY EXPRESS WASH CONCEPTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. EXPRESS WASH CONCEPTS DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.


UNDER NO CIRCUMSTANCES WILL EXPRESS WASH CONCEPTS BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO YOUR MEMBERSHIP OR USE OF EXPRESS WASH CONCEPTS CAR WASH SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.


You may have additional rights under certain laws (including consumer laws) which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in these Terms that directly conflict with such laws may not apply to you.



14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions and your membership are governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles. Any legal action arising from or related to these Terms shall be commenced or prosecuted in the state or federal courts located in Franklin County, Ohio.



15. SEVERABILITY

If any provision of these Terms and Conditions is adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions will otherwise remain in full force and effect.



16. MODIFICATIONS TO THESE TERMS

Express Wash Concepts reserves the right to modify these Terms and Conditions at any time. The most current version of these Terms, which supersedes all previous versions, can be reviewed at portal.expresswashconcepts.com. Your continued use of your membership after any modification constitutes your acceptance of the revised Terms.


Express Wash Concepts reserves the right to modify these Terms and Conditions at any time. For material modifications — including changes to membership fees, cancellation policies, or member rights — we will provide sufficient advance written notice to the email address on file before such changes take effect. Non-material modifications, such as clarifications, formatting changes, or updates required by law, may take effect immediately upon posting. If you do not agree with a material modification, you may cancel your membership prior to the effective date of the change in accordance with Section 2, without penalty. Your continued use of your membership after the effective date of any modification constitutes your acceptance of the revised Terms. The most current version of these Terms can always be reviewed at portal.expresswashconcepts.com.



17. ACCEPTANCE OF TERMS

Enrollment into the Express Wash Concepts Unlimited Wash Club is considered acceptance of these Terms and Conditions. By enrolling, you represent that you have read, understand, and agree to be bound by all provisions herein.
